Why not obtaining alcohol illegally?

It is not illegal to have alcohol in your system as a minor. How does the government prove how she obtained it?

Btw NY law does not make it an offense (criminal or otherwise) for a minor to obtain alcohol. However, it is criminal for adults, generally speaking, to sell it or give it to minors.
