Tomkins Cove Man Hit with DWI, Drug Charges in Pearl River

Police: 35-year-old pulled over for erratic driving on Route 304.

A Tomkins Cove man was charged with drunken driving and illegal drug possession after he was pulled over by police on Route 304 in Pearl River for driving erratically early Wednesday, according to Orangetown Police.

Police said Gregory J. Agatstein, 35, of 4 Herbert Court, was found to have nearly twice the legal amount of alcohol in his system after he was stopped at 4:22 a.m. as he was driving northbound on Route 304 in a 2007 Subaru. 

As he was being processed, police said they found Agatstein had a bag of marijuana in his pants pocket along with a device used for smoking marijuana. Police said they also found Agatstein was in possession of a pill bottle containing the prescription medication Clonazepam, for which Agatstein did not have a prescription.

Agatstein was charged with the misdemeanors of driving while intoxicated and seventh-degree criminal possession of a controlled substance, unlawful possession of marijuana, a violation, and several traffic violations.

Agatstein was released pending a hearing in Orangetown Town Court in Orangeburg on Jan. 30.
