Appellate Division Affirms Stewart Re-Election as Orangetown Supervisor

The Rockland County Board of Elections is expected to finally certify a two-vote victory by incumbent Democrat Andy Stewart in the election for Orangetown Supervisor Monday, one month and 18 days past Election Day.

The New York State Supreme Court Appellate Division affirmed the rulings by Acting State Supreme Court Judge Victor Alfieri related to petitions filed by Stewart and Republican challenger Walter Wettje, with notice going out to the candidates' attorneys late Friday. 

According to court documents, all four justices on the Appellate Division panel agreed with Alfieri's rulings. Wettje could turn to the state Court of Appeals, but it could be difficult to get another stay that would again delay the certification of the results.

Stewart held on to the two-vote advantage when six absentee ballots were counted Dec. 11. That came one day after Alfieri ordered that six other ballots not be counted. Read the initial Patch report on the Appellate Division ruling Dec. 20 here

Stewart also won a close election two years ago and he will complete his first term as Orangetown Supervisor Dec. 31.
